A Landmark Victory for Survivors: SASANE Wins Strategic Litigation Case in the Supreme Court of Nepal

Samrakshak Samuha Nepal (SASANE) has achieved a landmark legal victory in the Supreme Court of Nepal, marking a significant milestone in our long-standing fight for justice for survivors of child sexual exploitation and human trafficking.

What began as a strategic litigation initiative to challenge critical gaps and ambiguities within Nepal’s legal response to child sexual exploitation has now resulted in a victory before the country’s highest court.

For years, SASANE witnessed first-hand how survivors, particularly children subjected to prolonged sexual exploitation could become trapped within a legal system where sexual exploitation, rape and trafficking were not always clearly differentiated. The consequences were profound: confusion in case registration and prosecution, lengthy legal processes, repeated questioning, delayed justice and, in some cases, further victimisation of the very children the system was meant to protect.

SASANE decided that responding case by case was no longer enough.

The system itself needed to be challenged.

From Survivor Experience to the Supreme Court

Drawing upon years of frontline legal assistance and the experiences of survivors, SASANE initiated a strategic litigation process before the Supreme Court of Nepal.

The initiative brought together survivor experiences, legal evidence and consultations with law enforcement officials, lawyers, district attorneys, Nepal Bar Association members and other stakeholders.

Most importantly, survivors were not simply represented in this process. Survivor leadership was embedded within it.

SASANE’s certified paralegals, including women with lived experience of human trafficking, supported the litigation process, survivor engagement and advocacy surrounding the case.

After years of persistence, legal advocacy and determination, SASANE has won the case.

A Victory Beyond One Courtroom

This victory is bigger than SASANE.

It belongs to every survivor who has struggled to be understood by the justice system.

It belongs to every child whose experience of exploitation deserves to be recognised with clarity, dignity and seriousness.

And it belongs to the survivors who transformed their own experiences into a demand for systemic change.

Strategic litigation was never only about winning a case. It was about confronting the structural barriers that make justice difficult for survivors and using the law to create change far beyond a single courtroom.

This judgment represents an important step toward a justice system that better recognises the realities of child sexual exploitation and places survivors at its centre.

From Surviving to Changing the System

Since its establishment, SASANE has believed that survivors must not be seen only as recipients of protection. They can become paralegals, advocates, professionals and leaders capable of transforming the very institutions and systems that once failed them.

This Supreme Court victory demonstrates the power of that approach.

A concern first encountered through frontline survivor cases travelled through community advocacy, legal research, stakeholder dialogue and ultimately to Nepal’s highest court.

Today, it has become a legal victory.
